CALL TO ORDER



The regular meeting of the City Council and Redevelopment Agency of the City of Highland was called to order at 6:05 p.m. by Mayor Jones at the Donahue Council Chambers, 27215 Base Line, Highland, California.



The invocation was given by Reverend Wayne Reynolds of Immanuel Baptist Church and the Pledge of Allegiance was led by Kevin Grimes of the Royal Rangers.

City Clerk Hughes stated there were corrections to the Minutes. Item number 3, page 7, right above item number 9 states Councilman McCallon twice. The second Councilman should be Timmer.



Item number 4, page 7, under item 14 states trade quarter. It should be corridor.



Item number 5, page 4, last page, Redevelopment Agency convened into open session, it should state with Councilman Timmer absent.



Item number 6, page 2, Councilman Timmer was absent. It was stated in the body but not under absent.

CITY COUNCIL/REDEVELOPMENT AGENCY LEGISLATIVE



26. City Historian

City Clerk Hughes stated that Bill Calvert has resigned as the City Historian, having been appointed by the City Council February 9, 1988. Staff is looking for direction as to whether or not Council wants to appoint someone else. Mr. Calvert is recommending Nancy Alexander, who is President of the Highland Area Historical Society and a member of the City Historic and Cultural Preservation Board, or if Council chooses, to have staff advertise as with other vacancies.



Councilman Timmer inquired as to whether Nancy Alexander was interested in the position.



City Clerk Hughes responded Ms. Alexander has not been contacted.



Councilwoman Scott stated she had contacted Nancy Alexander and asked her if she would accept the position if the Council so saw fit and Ms. Alexander stated she would.

A MOTION was made by Councilwoman Scott, seconded by Councilman McCallon, to appoint Nancy Alexander as City Historian. Motion carried, 5-0.



Mayor Pro Tem Lilburn inquired as to why Mr. Calvert was resigning. Was he just tired of it?



City Clerk Hughes responded Mr. Calvert had not stated anything other than what the letter had stated, that it was time to go on to other things.



27. San Bernardino International Airport Interagency Cooperative Agreement



Community Development Director Jaquess stated this item is before you as a follow-up to the action by the San Bernardino International Airport which the Board recently approved and entered into the agreement between the City of Highland and San Bernardino International Airport Authority. This action is consistent with the documents that the Council had previously reviewed in Closed Session and it was considering this under threat of litigation. At this point in time, staff recommends that the document before you be ratified and make it an official part of the city record.



Councilman Timmer asked didn't we already approve this agreement?



City Manager Hughes stated we put it on the calendar for ratification for public record.



Mayor Pro Tem Lilburn stated this is after the Mayor of San Bernardino has signed it.



Councilwoman Scott stated Council is ratifying the final one that has the signatures on the bottom of the page.



Mayor Jones stated he also has copies of the minutes from SBIAA that he will furnish to put on our records and file with that, and those are the minutes of the approval between SBIAA and IVDA.



A MOTION was made by Councilwoman Scott, seconded by Councilman McCallon, to ratify the San Bernardino International Airport Inter-Agency Cooperative Agreement. Motion carried, 5-0.



28. Greenspot Road Master Plan

City Engineer Wong stated six weeks ago you participated in a joint study session with the Planning Commission and the Design Review Board to review a draft of the Greenspot Road Master Plan and during that meeting, 11 issues were raised. Three weeks ago, the Planning Commission officially reviewed the Master Plan and offered their official recommendation to you for adoption of the Master Plan as presented to them. The 11 issues were addressed at the Planning Commission meeting and also their recommendation to you is listed in the City Council Staff Report. Since we had a pretty lengthy discussion on this topic at the Study Session, I did not intend to go over the Master Plan with you, or go over all 11 issues with you verbally, because they are all in the Staff Report. However, I would like to hit a few highlights of the Master Plan. You have as part of your staff report a fold-out map of the Master Plan which gives you an overall view of that portion of Greenspot Road in the Golden Triangle area. Behind that, there are some larger blow-ups of that fold-out map for you to look at the details. But just to hit the highlights, this Master Plan in front of you has been revised to show consistently three travel lanes in each direction, going both east and west, improving that portion in front of Carino Plaza. You may recall that the draft Master Plan only showed two west-bound lanes in front of Carino. That has now been revised. Essentially, the alignment of the street has been shifted to the south for a width of 12 feet. It will require additional dedication from future development located at the southwest corner of Boulder and Greenspot. However, the City will be able to compensate for some of their losses in the dedication through vacation of some excess right-of-way along Boulder Avenue. Although they will be losing some land on the north side of the project, they will gain some along the east side of the project. The second major item of the Master Plan is the Planning Commission recommends approval of the median openings between each of the two traffic signals. There will be a total of three of those openings, three on each side allowing for left-in movement between the traffic signals. The Planning Commission, however, did not recommend adding one additional signal between the freeway and the first signal light intersections shared by Lowes and the Regency project. They continue to recommend that a left-in median opening would be adequate and appropriate type of control measures. However, for this particular location, the median opening between the freeway and the signal light intersection of Lowes and Regency will be specially designed so that it will allow for temporary removal of any blockage that would block County Flood Control from using that access during their dirt hauling operation. The Flood Control District Director came to our Planning Commission meeting and raised a concern about the need of maintaining that opening for the Flood Control property at least for a few more years or for whatever time it takes until they sell the property in the future. At that point of concern, they would not own the property any longer and would no longer need that turn out from the property on Greenspot Road. The Planning Commission directed staff to do a specialty sign for that location that would allow the removal of a portion of the curb channelization during the days Flood Control would need to use that area. When they are done, we could put the curb back in so that would require some special consideration. Also, the proposed Master Plan shows a right turn lane for deceleration purposes at all signal light intersections. The Planning Commission did not recommend to you that the deceleration lane be provided at every project driveway, just provided at the signal light intersections. Other than that, there are few other items that really do not affect the design of the Greenspot Master Plan, and I will not go into discussion of any of those items. Before I finish, I just want to mention that, although the Master Plan shows some driveway designs to new developments, for example it shows on page 6 of your Staff Report, that access A, which is the shared driveway between the Lowes and Regency project, is shown for concept and reference only. The exact designs of any driveway into private development is not a part of the Master Plan. The Master Plan is only dealing with Greenspot itself. For example, this Access A was reviewed by the Planning Commission and they have agreed to reduce the width of Access A in this drawing to a lesser width. Basically reducing it by six feet by eliminating the right-turn defect right-turn lane for the northbound traffic. I want to mention it so it is clear on the record. That portion of that Master Plan is not correctly reflecting the latest decision by the Planning Commission.



Councilman McCallon complimented staff and the Planning Commission for addressing all the concerns that were brought up. He stated that most of it is very well done. He has a concern about the Flood Control property, keeping an access open so Flood Control can exit and make a left turn with no traffic control at all. How is that going to be accomplished? Even if they are provided an opening, that street is so busy. How is that going to be effective?



City Engineer Wong responded the Master Plan did not say that there would not be any traffic control. Traffic control can be temporary, such as a flag person during the hours trucks need to exit out into traffic. Flood Control needs to have City permission to perform the dirt hauling operation, as was done before. We work with them on their timing of operation and try to avoid peak hour operation.



Councilman McCallon stated he thought the accessing of that land was eminent.



City Engineer Wong responded the Flood Control District Director anticipates the property will eventually be used for commercial use, and the Director did not indicate what the private use will be at this time. The Director did indicate that in the near future, it was anticipated the property will be sold.



Mayor Jones stated it is proven in the past the property is used only in the purpose of an emergency. In an emergency, he would hate to have the property causing great conflict onto Greenspot, especially after the City has developed it, without some kind of control there. He proposes that we approve the signal there, and then in the future, if we decide not to use it, that would be okay. But we have approved it with the signal and, in fact, it can be used and developed that way if it becomes necessary to do so.



City Manager Hughes stated if you look at page 14 of the Staff Report, there is an alternate design with the signal.



Councilman Timmer stated if Flood Control sells, then the signal location would be given up.



Mayor Jones responded not necessarily. Equally, the access to that property if in fact Flood Control sells it, may be desired by that particular tenant rather than having to come back across or revert back to other groups.



Councilman Timmer asked would the signal only be used during emergencies by Flood Control?



Mayor Jones responded no. It could be used for anything by commercial or by Flood Control, either one.



City Engineer Wong stated the Planning Commission considered this item for which you can find some discussion on page 2 of your Staff Report, item 4. This is a situation where a median opening was proposed and agreed on by the Planning Commission, considered to provide adequate access to the property on both sides of the project. We also have two additional traffic signals that provide full turning movement, in and out of the project, on both sides of Greenspot Road. Generally speaking, if you have other viable alternatives, you do not want to put a signal very close to a busy freeway intersection because by itself, it creates other concerns. The Planning Commission considered that and feels we do have other viable alternatives which are being proposed here with the traffic signal and the left end median opening, therefore, they are not recommending an additional signal.



Councilman McCallon stated we do not know who is going to acquire that property. It may be one of the gentlemen out here or it may be somebody else, depending on who comes up with the most money. Councilman McCallon would like to see a signal there from the standpoint of providing access to that property. It is assumed that Mission Development will acquire that property and that may happen. But someone else may decide to buy it and put something else there. He stated a signal light should be put there to provide access to that property regardless of who acquires it, and it will also solve the Flood Control issue at the same time.



Councilman Timmer stated he supports the Planning Commission's proposed recommendation. All you have to do is drive down Base Line and see what Seine does there. We're talking about a traffic signal about the same distance from the off-ramps on the freeway. That is becoming a more and more difficult intersection to get through at the peak hour with traffic backing up across that road, and getting on and off the freeway, is not as safe as it should be. If we want three signals, we should move them all further down. Having a signal that close to the freeway does not make sense.



Mayor Jones stated the issue is we want to be able to provide a smooth flow of traffic. To access that property without a signal, the turn lanes there will create an even more hazardous situation than having a signal there. If it is truly congestion and safety that we are concerned with, the only way to do it is with a signal, not with the turning lanes.



City Engineer Wong stated the Flood Control Director did not anticipate using that property for dirt hauling purposes. It will be only in rare instances. For example, when there is a fire and the silt gets washed down into the basin, the property needs to be used for stockpiling purposes. It would be a pretty rare situation where the access road will be used for making left turns out. The traffic is not that busy yet, for the next year or two, because we have not fully developed the area and the City is not fully developed yet. Therefore, for the next several years, the signal should not be needed for Flood Control purposes. There has been another system that indicates the Master Plan provides two additional signals, in three locations for median openings, that facilitate very effective traffic movement. Adding a signal does not add to the efficiency, and could create other problems.



Councilwoman Scott stated she has some concerns. Three accesses to the north have been planned, just by virtue of the median. If the planned residences go in the property as well as the movie theater and the other commercial, I really seriously doubt that, especially the one closest to the freeway, that one access is going to be enough for ingress and egress. Also, as you go down to Webster, it shows the driveway for the access into the property on the west side, but the little triangle piece that is already developed doesn't show the access point. It shows everything being curbed.



Mayor Jones stated the curb cuts are already there.



Councilwoman Scott stated I know they are already there but they need to be shown on the map. I believe just for that small area there are three curb cuts.



City Engineer Wong stated there are two, one on Greenspot and one on Webster.



Councilwoman Scott stated there is only one on Webster and then there is one on Greenspot which is Webster.



Councilman Timmer stated no. There is one between Webster and Boulder.



Councilwoman Scott stated the other concern had been brought up when they had the joint meeting with the Planning Commission regarding the delivery access off of Boulder for the trucks and vehicles that are going to be delivering to Lowes and the other stores.



City Engineer Wong stated Lowes will use the signal.



Councilwoman Scott stated she would rather the delivery trucks be in the back of the property.



City Engineer Wong stated those projects have a driveway all the way back to the end of the access road. From the first signal intersection, you can go all the way to the south side to the end of the road and then take a driveway to the back.



Councilwoman Scott stated then there will be a driveway going the other way, going east.



City Engineer Wong stated yes.



Councilman Timmer stated a lot of these things are speculative until the projects come in and go through Design Review and Engineering. We are here basically to focus on the Greenspot corridor. If we start talking about individual properties and how they turn around, we don't have enough hours. They are all good questions, but we will have lots of opportunities to address those questions at future meetings when they actually submit projects.



Councilwoman Scott stated she doesn't want to see money spent on the cuts and the medians and signals and so forth and then change the plans.



City Engineer Wong stated there have been several traffic reports done for Greenspot Road because we have several development projects happening almost at the same time. Each of them study the access points, and this portion of Greenspot Road as a whole, adding their project to the overall project. So we actually have three traffic studies done individually by the developers and then one done independently by the City, taking the entire City General Plan traffic, including all these proposed projects, into consideration. We have four traffic studies done, and each of them identify that the two traffic signal intersections will be operating within the acceptable level of service. It is all confirmed by all the traffic studies that we have. This is what we base our Master Plan on. If it is not sufficient, then certainly we need to provide additional access points but everything points to them being adequate.



Mayor Pro Tem Lilburn stated I understand two traffic signals are acceptable to our traffic flow, however, we are doing a Master Plan, and someone could be shorted access if other developers don't acquire this. We are assuming that one of these developers are going to get it but we need to make sure we don't make assumptions.



Councilman Timmer stated he interprets the drawings as showing a left turn into that property. There is a curb and a cut in the median. You can certainly turn in coming from the east. You can still turn across there. It is just not going to be controlled.



Mayor Jones stated you cannot leave that property and make a left turn to go east.



City Engineer Wong stated that is a very good question. This is a Master Plan not only for street but for land use for Greenspot Road with the Golden Triangle. When we look at the project, we do not look at just one project at a time. We look at the overall development of the entire Greenspot Master Plan and we have already had discussions with Mission Development over two years ago to address access of the Flood Control parcel through Mission Development's site. Mission Development's draft site plan has always indicated access points from their sites to the Flood Control property. The purpose is so we do not create access points for each individual parcel so everything is coordinated and designed together. That is what the Master Plan is supposed to do.



Mayor Jones stated as engineers design things, some things may be acceptable to them but not acceptable to others. I remember a particular car that the automobile engineers designed and engineered, and the only way you could change the spark plugs on it was to pull the engine out. That was acceptable to the engineers but not to those who had to work on the cars afterwards. It was unacceptable to the owners because the cost of changing a set of plugs was the total cost of pulling the engine out. So I would move the approved plan as so designated with using the alternate traffic signal design included within it at this time and I think that would solve all of our problems. That way we are doing the ultimate design, and if we need something less than that, we can worry about that at a later time. At least we have ultimately designed it to give access to all properties no matter what their use is going to be, whether they are Flood Control, whether they are commercial or what the development is, and allow the traffic flow accordingly with that. So that would be the approval as it is, with the addition of the alternate design of the traffic signal there at that first access.



Councilwoman Scott stated what if you cannot go east from the north property and residences are planned for the north property.



Councilman Timmer stated no, that parcel is commercial.



Councilwoman Scott stated she thought it was going to be mixed use.



Councilman Timmer stated the two existing signals they are showing as it is now, would access the residential properties on Boulder, would provide access. At this point, the Flood Control property we are talking about does not show any residential housing, and I do not believe it would either.



City Engineer Wong stated Mission Development's residential property is further back. They are not fronting Greenspot Road. However, the first traffic signal from the freeway will be used for the residents.



Councilwoman Scott stated the reason she brought it up is because, unless we are expecting all childless people to move there, we have to remember that the schools that anyone would attend, are all east.



Councilman Timmer stated no, that is San Bernardino School District.



Mayor Jones stated it is west of Eucalyptus which is the dividing line.



Councilman Timmer stated he does not have much faith in traffic studies, however, just from observation with the street of Seine, we all know that it is cumbersome and to now plan to do that again does not make sense. I think the Planning Commission has made a good recommendation to use and to put another signal between that one and the freeway does not make sense. I cannot support that. I think the overall project is good and I can support that, just that specific signal I cannot.



A MOTION was made by Mayor Jones, seconded by Councilwoman Scott, to adopt Greenspot Road Master Plan as amended with approval of alternate design which will include one more traffic signal. Motion carried 4-1, with Councilman Timmer dissenting.



Mr. Khaled Farah stated we are the civil engineering company that usually represents Universal Self Storage. This is a property that no longer has any access on Greenspot Road. First, we never received any development notices nor any invitation to the Planning Commission for any of those projects which we are in the vicinity of Universal Self Storage. Second, we are very concerned that the storage facility has access. We already have two accesses on Greenspot. The traffic signal that is going for Wal- Mart, requiring a right hand turn lane into that traffic signal, which means one of our existing accesses to Greenspot Road has been taken away. And now we have to access through the street that accesses Wal-Mart and our trucks will have a very hard time accessing our side into that and going back onto Greenspot, which means our clients will be on-coming to our site. Greenspot Road as it looks now, and I heard many people be concerned about putting a traffic signal specific for a property that has not even be developed, whereas a property that has already been developed and has been there before any of the new developments came in, is not being given any access on Greenspot. These are items I want to have on record because the storage facility has already been damaged with that construction and I believe it will be damaged considerably with the new Greenspot Road as it is going to come and the Wal-Mart access as you are planning to give it to this specific property.



Councilman McCallon asked if Universal Self Storage owns the property that fronts on Greenspot.



Mr. Farah responded yes.



Councilman McCallon stated so when that property is developed you will probably have access onto Greenspot.



Mr. Farah stated on Greenspot we will not be able to, if you look at the map at the right hand turn lane, getting to the traffic signal, and how it is being proposed to give us access, which is dividing our manager's office from the rest of the second storage facility.



Councilman McCallon stated you will have access coming off Greenspot at some point when the property in front develops.



Mr. Farah stated it does not show that on the map as indicated now.



Mayor Jones asked City Engineer Wong if staff met before with this owner and discussed these proposed changes.



City Engineer Wong replied staff is in the process of making contact with the property owner. We have just met with the engineers of the mini-storage yesterday.



Mr. Farah stated they were never contacted. Mr. Farah's clients asked him to contact the City because the managers of the storage knew about this meeting and knew about the Greenspot Road, and the managers contacted the developer, and the developer contacted me to come see what was happening. We did not know that it was not a public hearing, and I appreciate you allowing me to speak here. It is an item that really needs to get noticed about what the damages are going to be to that property.



Councilman McCallon asked were they not noticed for the Planning Commission meeting?



Community Development Director Jaquess stated he cannot say for sure that they were. There were telephone calls made, not written notice.



Mayor Jones asked were there any contacts made?



Community Development Director Jaquess stated he cannot say for sure whether they were at the Planning Commission meeting.



Councilman McCallon asked is making telephone calls normal procedure?



Councilwoman Scott stated she thought everyone within 300 feet received written notification.



Mayor Pro Tem Lilburn stated are they within 300 feet.



Major Jones responded yes they are, but this is not a public hearing. It does not require written notice.



Councilman Timmer stated we have only received one project for this whole corridor, and that is the Lowes project, and they are well more than 500 feet away.



Community Development Director Jaquess stated there have not been any hearings held for the Regency project or the Wal-Mart project. They will get noticed in the mail for those projects when they are held.



Mayor Jones stated when we are doing a redesign of the total street in front of it, it would seem to me that we would want to contact every single property owner.



Community Development Director Jaquess stated we have communicated through the manager's office several times over the past several months to keep them informed of the process for various meetings that we have held, including the Joint Planning Commission, Design Review Board, City Council Workshop, and in fact I know the managers have been in the audience in the past in previous meetings.



Mayor Jones stated but they are not the owners. It would behoove us to make an appointment with the owners, talk about the access and how that can be achieved. There would be nothing wrong with that deceleration zone right turn lane there still opening up to that property allowing them to turn in there.



Mr. Farah stated he had met with City Engineer Wong yesterday and we feel that we can work this item out. We have a meeting with City Planner Mainez on Thursday at 2:30 p.m. also to go over this. However, my clients wanted it to be on record that we did come up and raise our concerns. We will try, however, to work it out with the City Engineer and with the Planning Department.



29. Update on SANBAG, SCAG, Omnitrans, Work Program and Regional/Legislative Issues/Development Issues/Subcommittees/AB 1234 Updates

Councilman McCallon stated there is nothing new on SANBAG and SCAG. Our meetings are this week, and we will be able to update you then, but nothing at this point.



Mayor Pro Tem Lilburn stated we have an Omnitrans meeting tomorrow. I did want to report that Mayor Jones appointed two of us Council Members to form a Mobile Home Ad Hoc, and with the help of Community Development Director Jaquess we set up a meeting, we selected some additional committee members from the Silver Creek Mobile Home Park, we met, and then we met again after a couple of the mobile home groups contacted Mr. Martinez, the owner of Silver Creek, to attend the meeting. After our first meeting, it sounded like there were a lot of issues, none of them really pertaining to rent control. We were able to meet, answer some questions, and our second meeting was even better. As of right now, Mr. Martinez, the owner of Silver Creek, has agreed to have a meeting with all of the residents and address their concerns. We do not have another meeting set up at this time. Hopefully, we have resolved a lot of issues and everyone is okay. I will keep you posted.



Councilman McCallon stated in accordance with AB1234, we need to report that three of us did attend the League's annual conference. There were some good sessions, all four of the resolutions were approved and, I believe, City Manager Hughes sent out an e-mail showing the final versions of all that to everybody. I was elevated to president of the division. The division has re-started the legislative task force and we will be getting some more information about that.



30. San Bernardino International Airport Authority and IVDA

Mayor Jones stated the last meeting of SBIAA was where they proposed to approve the mitigated EIR which was approved. I voted against it with half of the cities, and yet it was approved. We went on the record that we voted against it, as well as South Coast Air Quality had a substantial list of comments that agreed with ours. This set the record so that somewhere down the road if we have to use another process, we will do so. We have a meeting tomorrow.



City Manager Hughes stated the latest Negative Declaration is sitting on the dais, and staff will be responding in similar fashion.



Councilwoman Scott stated will we also be responding to LAFCO regarding the municipal takeover of water conservation. I know we have responded once already.



City Manager Hughes stated that document is basically stating that they will be doing an EIR so we will be responding at the EIR stage.
